This document outlines the rules and conditions governing the use of ADAK CAPITAL PVT .LTD.’s Web Portal, Mobile Application, and associated platforms, including any sub-domains or services developed, owned, or operated by ADAK CAPITAL PVT .LTD. or its affiliates. Hereafter, ADAK CAPITAL PVT .LTD. refers to the company itself.
In accordance with the Information Technology Act, 2000, this is an electronic record generated by a computer system, and no physical or digital signature is required. Your use of the platform, services, and products (collectively referred to as “Services”) constitutes acceptance of these terms.
Terms like “You,” “User,” “Client,” “Investor,” and “Customer” refer to anyone accessing or using the Services offered by ADAK CAPITAL PVT .LTD., including singular and plural references. Services are intended exclusively for Indian residents and taxpayers.
By downloading the app, using the Web Portal, or accessing ADAK CAPITAL PVT .LTD.’s Services on any platform, you enter into a binding agreement (the “Agreement”). By using the platform, you confirm that you have read, understood, and accepted these terms.
Please review these terms carefully. If you do not agree, do not use the platform or services. This Agreement should be read alongside the privacy policy and any other applicable documents.
References to laws, regulations, or statutes include amendments, rules, and instruments currently in force. Headings and formatting are for convenience only and do not affect interpretation.
You confirm that you are over 18 years old or have obtained consent from a legal guardian and are competent to enter into this Agreement, make investment decisions, and comply with these terms.
ADAK CAPITAL PVT .LTD. offers mutual fund advisory and transaction execution services. Advisory services rely on data from third-party providers and do not constitute legal, tax, or accounting advice.
Users retain the freedom to execute transactions independently of advisory services. Viewing mutual fund information does not constitute advice. ADAK CAPITAL PVT .LTD. only collects and forwards investment orders to Asset Management Companies (AMCs) or authorized registrars (RTAs) and is not responsible for incorrect or failed execution due to system errors or third-party failures.
The platform may collect NAV and mutual fund data from AMCs, AMFI, RTAs, or third-party vendors to keep information updated. While accuracy is prioritized, the company is not liable for discrepancies. Users should verify information directly with the relevant AMCs or RTAs.
To use the Services, Users must complete KYC and provide accurate personal details as per SEBI, AMCs, RTAs, or other regulatory authorities. ADAK CAPITAL PVT .LTD. may share your information with relevant third parties to provide services, including marketing communications.
Users are responsible for safeguarding their login credentials. Commercial use of the platform is prohibited. Users must comply with all applicable laws and not tamper with security features or content.
The company is not responsible for delays or failures due to infrastructure issues. Users must notify ADAK CAPITAL PVT .LTD. of any significant changes in their profile. Tools like calculators are for guidance only and do not constitute professional advice.
Users authorize ADAK CAPITAL PVT .LTD. to use their KYC records, including signature information, for transactions with AMCs and RTAs. Actions taken in good faith by AMCs or RTAs based on KYC records are valid and not subject to recourse.
The platform may provide links to external websites for transactions or verification purposes. ADAK CAPITAL PVT .LTD. is not responsible for the content, policies, or actions of these third-party sites. Users should review third-party terms and privacy policies independently.
Users can make payments for mutual funds using UPI, Net Banking, IMPS/NEFT/RTGS, or other approved modes. Transactions through third-party gateways are final. Users must use their own bank accounts.
For mutual fund transactions, the company serves as an intermediary and is bound by the timelines and capabilities of AMCs, RTAs, banks, and payment gateways. Settlement of funds and unit allocation is subject to NAV availability and cut-off timings. ADAK CAPITAL PVT .LTD. is not responsible for delays or system failures.
Users must maintain the confidentiality of proprietary and sensitive information obtained from the platform, both during and after the termination of the Agreement. Unauthorized use, reproduction, or distribution of company information is prohibited.
ADAK CAPITAL PVT .LTD. may suspend or terminate user access at its discretion, with or without notice. Users must discontinue use upon termination.
The company, its affiliates, and partners are not liable for direct, indirect, incidental, consequential, or punitive damages arising from the use of the platform or services, including investment outcomes, lost opportunities, or system failures.
Users agree to indemnify ADAK CAPITAL PVT .LTD., AMCs, RTAs, and associated entities against claims, losses, or damages arising from misuse, breaches, or unauthorized actions related to the Services.
Services and information are provided “AS IS” without warranties or guarantees. ADAK CAPITAL PVT .LTD. does not warrant uninterrupted access, error-free content, or accuracy of third-party information. Users assume full responsibility for investment decisions.
Users may not copy, modify, distribute, or commercially use platform content without express permission.
ADAK CAPITAL PVT .LTD. may modify these terms at any time. Users who disagree with changes must discontinue use of the services.
Communication may be sent via email, WhatsApp, SMS or physical mail. Users must keep contact information up-to-date. Electronic communications are not guaranteed to be secure.
ADAK CAPITAL PVT .LTD. does not provide any refunds or waivers under any circumstances.
Disputes will first be attempted to be resolved amicably. Failing that, binding arbitration will occur under Indian Arbitration & Conciliation Act, 1996, conducted in English.
This Agreement is governed by Indian law, and disputes are subject to courts.
